K-12 Scholarship Changes
Description
This bill: (1) defines an eligible student for a special education scholarships for children with disabilities as one who resides in NC and meets all of the following criteria: (a) a child with a disability; (b) is eligible to attend a NC public school (a child who is the age of 4 on or before April 16 is eligible to attend the following school year if the principal or equivalent of the school in which the child seeks to enroll finds that the student meets the requirements of G.S. 115C-364(d) and those findings are submitted to the Authority with the child's application); (c) has not been placed in a nonpublic school or facility by a public agency at public expense; (d) has not been enrolled in a post-secondary institution as a full-time student taking at least 12 hours of academic credit; (e) has not received a h.s. diploma; (2) these scholarships will be given first to eligible students who received one for the prior school year and then will go to the other eligible students; (3) defines an eligible student for Opportunity Scholarship Grant Programs as one who has not yet received a h.s. diploma and meets all of the following requirements: (a) meets one of the following criteria: (i) was a full time student assigned to and attending a public school or enrolled in a Department of Defense Elementary and Secondary School in NC during the spring semester before the school year for which the student is applying; (ii) received a scholarship grant for the prior school year; (iii) is eligible to enter either kindergarten or 1st grade (a child who is 4 on or before April 16 is eligible to attend the following school year if the principal or equivalent of the school in which the child seeks to enroll finds that the student meets the requirements of G.S. 115C-364(D) and those findings are submitted to the Authority with the child's application); (d) is a child in foster care; (e) is a child whose adoption decree was entered not more than 1 year prior to submission of the scholarship grant application; (f) is a child whose parent or legal guardian is on full-time duty status in the active uniformed service of the US including members of the National Guard and Reserve on active duty orders; (4) these scholarships will be given first to eligible students who received one for the prior school year and then will go to the other eligible students; (5) defines an eligible student for the Personal Education Savings Accounts as a NC resident who has not yet received a h.s. diploma and meets all of the following requirements: (a) is eligible to attend a NC public school (a child who is the age of 4 on or before April 16 is eligible to attend the following school year if the principal or equivalent of the school in which the child seeks to enroll finds that the student meets the requirements of G.S. 115C-364(d) and those findings are submitted to the Authority with the child's application); (b) has not enrolled in a post-secondary institution in a matriculated status eligible for enrollment for 12 hours of academic credit; (c) is a child with a disability, including intellectual disability, hearing impairment, speech or language impairment, visual impairment, serious emotional disturbance, orthopedic impairment, autism, traumatic brain injury, other health impairments, specific learning disability or disability as may be required to be included under IDEA; and (d) has not been placed in a nonpublic school or facility by a public agency at public expense.
